Terms of Service

These Terms of Service ("Terms") govern your access to and use of DailyMuse, a service operated by dp.vision ("we", "us", or "our"), available at dailymuse.app (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

DailyMuse is a voice-first AI content companion that helps users create social media and marketing content. The Service includes:

• Voice recording and transcription: Record voice memos that are automatically transcribed using AI speech-to-text technology.
• AI content generation: Generate social media posts, articles, and other content drafts from your voice recordings and brand profiles.
• Brand profile management: Configure your brand voice, target audience, and content preferences.
• Content management: Organize, edit, and export your generated content.

The Service is currently in beta. Features, availability, and functionality may change without prior notice.

To use the Service, you must create an account by providing a valid email address. Access may be subject to a waitlist during the beta period.

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately at hello@dailymuse.app if you suspect unauthorized access to your account.
• You may not create multiple accounts or share your account with others.
• You must be at least 16 years old to create an account.

DailyMuse is currently offered as a free beta. During the beta period:

• The Service is provided "as is" without any service level agreement (SLA).
• We may introduce, modify, or discontinue features at any time without prior notice.
• We may limit the number of users, recordings, or content generations.
• We may transition to a paid model in the future. If so, you will be notified in advance and given the option to continue under the new terms or delete your account.
• We do not guarantee uptime, response times, or uninterrupted access to the Service.

You agree not to use the Service to:

• Create, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Generate content that infringes on any third party's intellectual property rights, privacy rights, or other legal rights.
• Impersonate any person or entity, or falsely claim affiliation with any person or entity.
• Attempt to gain unauthorized access to the Service, other accounts, or any systems or networks connected to the Service.
• Scrape, crawl, or use automated means to access the Service or extract data, except through our official API (if provided).
• Interfere with or disrupt the Service or servers or networks connected to it.
• Use the Service to send spam, chain letters, or unsolicited bulk communications.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Use the Service in any way that violates applicable laws or regulations.
• Circumvent any rate limits, usage restrictions, or security measures.

We reserve the right to suspend or terminate your account if you violate these terms, without prior notice.

6.1 Your Content

You retain all rights to the content you create, upload, or input into the Service, including voice recordings, text, images, and brand profiles ("Your Content").

By using the Service, you grant us a limited, non-exclusive, worldwide license to process Your Content solely to provide and improve the Service. This license terminates when you delete Your Content or your account.

6.2 AI-Generated Content

Content generated by the AI based on your inputs ("Generated Content") belongs to you to the maximum extent permitted by applicable law. You are free to use, modify, and publish Generated Content without restriction.

You acknowledge that AI-generated content may be similar to content generated for other users. We do not guarantee exclusivity or uniqueness of Generated Content.

6.3 Our Platform

The Service, including its design, code, algorithms, branding, documentation, and all underlying technology, is and remains the exclusive property of dp.vision. These Terms do not grant you any rights to our intellectual property except as expressly stated.

DailyMuse uses artificial intelligence to generate content. You acknowledge and agree that:

• No guarantee of accuracy: AI-generated content may contain factual errors, inaccuracies, or outdated information. You are solely responsible for reviewing and verifying all generated content before publishing or using it.
• No professional advice: Generated content does not constitute legal, financial, medical, or other professional advice.
• Your responsibility: You are solely responsible for all content you publish, regardless of whether it was AI-generated. You must ensure that published content complies with applicable laws, does not infringe third-party rights, and is appropriate for your audience.
• AI limitations: AI models may produce unexpected, biased, or inappropriate outputs. We continuously work to improve quality but cannot guarantee that outputs will always meet your expectations.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

We strive to provide reliable access to the Service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

• Scheduled or unscheduled maintenance.
• Technical issues with third-party providers (hosting, AI services).
• Force majeure events beyond our reasonable control.
• Updates, upgrades, or feature modifications.

We will make reasonable efforts to notify users of planned downtime in advance, but are not obligated to do so during the beta period.

To the maximum extent permitted by applicable law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be error-free, secure, or uninterrupted, or that any defects will be corrected.
• In no event shall dp.vision, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Service.
• Our total aggregate liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the amounts you have paid us in the twelve (12) months preceding the event giving rise to the liability, or EUR 100, whichever is greater.

Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

You agree to indemnify, defend, and hold harmless dp.vision and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service.
• Your violation of these Terms.
• Content you create, upload, or publish through the Service.
• Your violation of any applicable law or third-party rights.

12.1 Termination by You

You may stop using the Service and request account deletion at any time by contacting us at hello@dailymuse.app. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

12.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms or our Acceptable Use policy.
• Prolonged inactivity.
• Discontinuation of the Service.
• Legal or regulatory requirements.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including intellectual property, limitation of liability, indemnification, and governing law provisions.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify you by email and/or by posting a prominent notice in the Service at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service and delete your account.

These Terms are governed by and construed in accordance with the laws of the Republic of Poland and applicable European Union law, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Poland. If you are a consumer resident in the EU, you may also bring proceedings in the courts of your country of residence.

If you are a consumer in the EU, you may also use the Online Dispute Resolution (ODR) platform provided by the European Commission at ec.europa.eu/consumers/odr.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and dp.vision regarding the Service. They supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.
